While these compounds are psychoactive, they differ in their molecular structures, leading to varied effects and potencies. Commercially available Delta-8 THC is often derived from hemp through a chemical conversion process from CBD.

Importantly, products containing THCa, Delta-8 THC, and Delta-9 THC are federally legal, thanks to the Agriculture Improvement Act of 2018, commonly known as the Farm Bill. This legislation removed hemp, defined as cannabis with less than 0.3% THC by dry weight, from the list of controlled substances. Delta-8 THC is also explicitly mentioned in the 2018 Farm Bill as a legal hemp-derived compound. Thus, products adhering to Farm Bill criteria can be legally shipped to most states in the US.

It's imperative to research and understand the laws of your destination and any states you may pass through. Generally, products derived from hemp with 0.3% THC or less are permissible if they comply with both federal and state laws. However, carrying any cannabis product with THC exceeding 0.3% is federally illegal, regardless of state legalization.
